XS General Terms and Conditions

 

  •  ETA is an expected date of arrival, not the official arrival date
  • Swap Container(s) vessel reloadings, extra vessel stops, delays due to late departures or typhoons, and more can seriously disrupt the schedule. This also applies to sharing LCL shipments. Delays of 1-2 or 3-4 weeks are normal.   
  • XS is not responsible for delays caused by political issues, wars, weather conditions, accidents, or fire in containers, ship/airplane / Train / Truck, or local Import/Export, late VAT/Duty payments, or local inspections.  Also not due to incorrect or late information from shippers, agents, traffic jams/accidents, and ( last minute) other sailing routers,  wrong customs documents or permits. 
  • Make sure to take this into account when you plan urgent deliveries to your customers.
  • XS has the right to block (not release) containers in the event of late payments; any delays caused by this are at your own risk.
  • Due to the high summer temperature, above 32c  (Lower Take-off max weight), the airliner may unload ULC plates again 5 min before departure, which will go with the next flight as a high priority.  We XS, does not have any influence in this matter
  • Some Ground handling Companies are very clumsy with the collection of airplane pallets, especially when it rains or snows!  Protect the goods from rain/snow, cover them with a large plastic cover bag, and seal them with foil beforehand. Pallet Max high 150 cm
  • Fully sealed pallets with side/corner protectors and plastic wrapping (Minimal  4) are essential to prevent damage and maintain the integrity of the shipments.  Using higher-quality 5-ply cartons would be ideal to ensure better protection during transit.  Fill up the cartons 100% and not 80 %. Boxes collapse if the filling level is too low.  Taped properly in both lengthwise and widthwise directions of the cartons/collis,  poorly taped/open cartons/collis are not covered by the insurance company.
  • Damage due to ad and low-quality cartons is at your own risk!     
  • Express parcels will be charged via Payweight format: (example: Carton 74×44×35/5000=22.8 kg Volume weight  / Gross weight = 18,00 Kg).
  • Air shipments will be charged via Payweight format:  (example: 1 cbm = 167 Volume weight  / Gross weight = 310,00 Kg, Shipments will be weighed and measured at the Air Cargo Terminal and not negotiated. The result will be used for invoicing/AWB/insurance, and you will be invoiced for the highest weight.
  • Shipments are not automatically insured. If you want insurance, you must request it in advance. Once the shipment is loaded, it is no longer possible to add insurance. 
  • Damage by not insuring shipments is at the owner's risk
  • Damage by overloading? Only damage notes on freight letters / cmr are official. Claims without any freight letters or CMR will not be accepted 
  • In the event of a fire breaking out on a vessel, container, train, plane, or truck,  XS reserves the right to abandon the shipment and comply with the instructions of our transport insurer or our shipper.  Please be aware that if the sender/client has not obtained insurance for their goods, they will not be entitled to any compensation. XS will always try to facilitate the transportation of goods to the final destination, provided they are in good condition.
  •  This is a service, not an obligation!  For your info, this will take a very long time due to paperwork, etc.
  • If previous documents are replaced with a new one, the most recently drafted documents will take precedence. Old or previous documents have no validity and don't have to be shown as evidence. If damaged shipments can be sent out. it will be under CFR. We are not responsible for local customs, local transport, and additional costs at the arrival port or destination!
  • Emergency Risk Surcharge (ERS) This fee, 28 USD, covers additional costs faced by the sea carrier when moving cargo in dangerous regions, including those that are threatened by hazards, violence, or piracy. It's  a worldwide fee and will be charged.
